1: These terms and conditions are issued on behalf of OCX Capital Limited T / A IT Worx, having its registered office at Unit 3, Market Square, Castlebar, Co.Mayo, registration No. 662693 in the Republic of Ireland who is the controller and responsible for this website.

3: IT Worx reserves the right to modify these terms and conditions by unilateral decision without prior notice.Orders are subject to the terms and conditions valid at the time of ordering, which are viewable on the it - worx.ie order page.Changes in legislation will come into effect immediately as such, unless the law otherwise specifies.

4: By visiting our site & / or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and / or available by hyperlink.These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and / or contributors of content.

5: IT Worx is not liable for any damages resulting from a force majeure, i.e.circumstances beyond its control.IT Worx will inform the Customer about any force majeure issues it faces as soon as it is possible.

6: We reserve the right to refuse service to anyone for any reason at any time.

7: You understand that your content(not including credit card information), may be transferred unencrypted & involve(a) transmissions over various networks; & (b) changes to conform & adapt to technical requirements of connecting networks or devices.Credit card information is always encrypted during transfer over networks.

8: The Customer is obligated to give their full contact information when making an order, which includes at minimum the Customer’s name, address, active telephone number and email address

9: Shipping time estimates are based on the information provided by the logistics companies.

10: We are not responsible if information made available on this site is not accurate, complete or current.The material on this site is provided for general information only & should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or timelier sources of information.Any reliance on the material on this site is at your own risk.

11: We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction.We may exercise this right on a case -by -case basis.We reserve the right to limit the quantities of any products or services that we offer.All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.We reserve the right to discontinue any product at any time.Any offer for any product or service made on this site is void where prohibited.

12: You agree to provide current, complete & accurate purchase & account information for all purchases made at our store.You agree to promptly update your account & other information, including your e - mail address & credit card numbers & expiration dates, so that we can complete your transactions & contact you as needed.

13: We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third - party websites.Please review carefully the third - party’s policies & practices & make sure you understand them before you engage in any transaction.Complaints, claims, concerns, or questions regarding third - party products should be directed to the third - party.

14: Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times & availability.We reserve the right to correct any errors, inaccuracies or omissions, & to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice(including after you have submitted your order).

15: New devices and products are sold with 21 % VAT.Pre - Owned and Grade A devices are sold under the VAT Margin Scheme and this does not give the right to an input credit of VAT.This means that an accountable person is not entitled to deductibility in respect of any VAT included in the purchase price of goods sold to him or her under the margin scheme.Repairs have 13.5 % VAT.

16: All general repairs come with a 90 day parts warranty where a replacement part will be fitted if a part failure occurs during the warranty period, any physical damage, water damage or third party repair attempts to the device or part voids the warranty.Motherboard repairs have a 1 month warranty.Batteries have a 1 month warranty.Water damage repairs do not have any warranty.We are not responsible for any data loss or software issues that occur during a repair, it is up - to the customer to ensure their data is backed up accordingly.

17: When buying a phone, please inform us within 72h of receiving the goods if you are not satisfied with the product for any reason.We will issue the customer a refund within 5 business days of receiving the customer’s phone, presuming the Find My iPhone feature has been disabled from the phone.

18: If it appears that the damage to a faulty device has been caused by the Customer, IT Worx is not liable for it.Possible such causes include, for example, causing physical damage to the device, using the device contrary to its instructions, or other negligent actions.

19: The screen breaking or cracking is not covered by the warranty.Software faults are not covered by the warranty.Removing viruses or other malware from the phone is not covered by the warranty.If the device has been plugged into an unearthed outlet, the damages are not covered by the warranty.Severing the power supply cables or physically opening the device will void the warranty.

20: Damage to the product during shipment due to the sender’s negligence is not covered by the warranty.The warranty is voided if the phone’s serial number or IMEI has been removed or otherwise made unreadable.Other indirect or purely financial damages caused by the breakage of the product, such as the destruction of files, are not covered by the warranty.The warranty is voided if the phone’s glass / home button / camera / other features have broken due to improper use, such as the phone having been dropped or having hit something.The warranty is voided, if a product bought from IT Worx has been repaired or a repair attempt has been made by the customer or a third party.The warranty is voided if the phone is bent or has been liquid damaged or any features have broken due to improper use, such as the phone having been dropped or having hit something.

21: When a case for returning a device arises you must inform us as soon as possible.Notifying us is to be done by email at shop @it-worx.ie.Upon notifying us and having received instructions on how to proceed, the faulty product is to be sent to us and a resolution will be provided.

22: You are responsible for backing up the files on the device before sending it in for repair.You are liable to pay for the incurred delivery costs.

23: You expressly agree that your use of, or inability to use, the service is at your sole risk.The service & all products & services delivered to you through the service are(except as expressly stated by us) provided ‘as is’ & ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, & non - infringement.

24: In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, & the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity & enforceability of any other remaining provisions.

25: These Terms of Service are effective unless & until terminated by either you or us.You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

26: The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

27: These Terms of Service & any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement & understanding between you & us & govern your use of the Service, superseding any prior or contemporaneous agreements, communications & proposals, whether oral or written, between you & us(including, but not limited to, any prior versions of the Terms of Service).

28: These Terms of Service & any separate agreements whereby we provide you Services shall be governed by & construed in accordance with the laws of Ireland.

29: We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates & changes to our website.It is your responsibility to check our website periodically for changes.Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
